The need to provide “Evidence of Use”
Has your trademark examiner refused to allow your application because your trademark is “likely to be needed by others”? Has your examiner stated that: “you may be able to overcome this problem if you do the following: Provide me with evidence of use or intended use …”.
Providing “evidence of use” involves drafting a letter and swearing a statement – usually in the form of a Statutory Declaration – which shows how you’ve used your trademark and which hopefully demonstrates that people think of you when they hear or see your trade mark.

IP Australia’s Official Trade Marks Manual recognises that “Evidence of Use may be expensive and time-consuming for an applicant to prepare”.
Traditionally, evidence of use is not easy for a lay person to prepare, and the alternative has been to send a box of documents and other materials to a lawyer or trademark attorney who could spend between a day and several days sorting through the details and preparing your declaration.
