Official Trademark Registration Fees
Sunday, 18 January 2009 • Category: Trademark Applications1. Introduction
IP Australia charges fees for the filing and registration of trademarks. These fees are usually added to the professional fees of any lawyer or trademark attorney who acts on your behalf – and can even amount to more than half of your total trademark registration costs! Currently, the smallest amount that you’ll pay in official application and registration fees is $370. But how much you’ll actually pay depends on how you choose to file your trademark application.
2. The options for filing your trademark application
a) How many trademarks are you applying for?
Usually, clients apply for one or two trademarks at once. For example, imagine that you manufacture and repair furniture using the brand name “Flavian”, and that your logo incorporates the word “Flavian” intertwined with a laurel wreath. You could register the word “Flavian” as a trademark, and your logo, and that would be regarded as two trademarks. Obviously, “Flavian” as a word or the logo would be regarded as one trademark.
b) How many classes will you be applying for?
Trademarks are divided into 45 separate classes, and you need to specify how many classes you want each trademark registered under. For example, “Flavian” would strongly consider registering its trademark(s) in classes 20 (furniture) and 37 (repair).
c) Will you be filing your application online, or with a physical (paper) form?
It’s slightly cheaper to file a trademark online rather than using the old paper forms. Unless you are very uncomfortable about using the Internet (in which case, what are you doing reading this site?), it makes sense to apply online.
d) If filing online, will you be using IP Australia’s “Goods and Services Pick List”?
IP Australia’s “Goods and Services Pick List” is an online tool designed to help you place your goods and services into the correct classes. We would only recommend this option if you’re not using a trademark attorney or IP lawyer.
